FINTANI Services Sdn Bhd (Co ID New 201301038875 (Old 1068698-X)) (“FINTANI”, “we”, “us”, “our”, “Group”) values and respects our customers’ rights in regards to their privacy and personal information in accordance with all relevant laws, including Personal Data Protection Act 2010 (“PDPA” 2010). This Privacy Policy (“Policy”) will describe our practices in collecting, holding and processing Personal Information given by our customers and this Policy shall be enforced alongside with the Terms and Conditions (“Terms”) and Terms of Service (“Terms of Service”).
  2. This Policy describes the following:
    1. How do we collect your Personal Information;
    2. How do we use your Personal Information;
    3. Disclosure of your Personal Information;
    4. Retention and Security of your Personal Information; and
    5. Your Rights to Access and Correct your Personal Information.
  3. By registering and using Danaaku Mobile Application (“App”), applying, registering and/or using for any of our products and/or services, you are deemed to have agreed to the collection, use and disclosure of your Personal Information in accordance with this Policy.
  4. There are specific provisions that may apply to the Terms and Terms of Service. Those specific provisions must be read together with this Policy. In the event of any inconsistency between this Policy and the specific provisions, this Policy shall prevail.
  5. In the event of any conflict between the English and other language versions, the English version shall prevail.

  1. This Policy serves as a notice pursuant to the PDPA 2010.
  2. We may modify, vary or amend this Policy from time to time to reflect any changes to the privacy practices. While we will not notify you of these changes, however, an updated version of this Policy will always be made available on the App. Please check the Policy regularly on the App to ensure you are updated on the latest version.

  1. We define Personal Information / Personal Data to be any information about you or someone else to identify you including but not limited to: full name, date of birth, gender, nationality, postal and email address, mobile number, identification details (including but not limited to NRIC or passport), payment details, transactions, financial details (including source of funds), sensitive personal data as defined under PDPA 2010 and other information relevant to FINTANI (collectively referred to as “Personal Information”). We define Third Party Information (“Third Party”) to be sources that are not linked or associated to your Personal Information. Third Party cannot be used to identify individuals. We may collect, record, process, use, hold, disclose and store any Personal Information including but not limited to:
    1. Information you provide to us through your usage of our Services including but not limited to:
      • Personal information from you including your first and last name, profile picture, gender, age, phone number, current address, email address, device ID number and passwords;
      • Information you consented whilst using our Services;
      • Information necessary to complete a transaction;
      • Information such as documents and messages stored inside our Services;
    2. Information from Third Parties which you have given your consent to disclose relevant information relating to you including but not limited to our affiliates, subsidiaries, employees, consultant, industry related associates, law enforcement agencies, government agencies or authorities;
    3. Information from Credit Reporting Agency including but not limited to Central Credit Reference Information System, (CCRIS) and/or any organisation licensed under Credit Reporting Agency Act 2010 i.e. CTOS Data System , Experian Information Services (M) Sdn Bhd;
    4. Information from other sources; and/or
    5. Information collected from you about others.
  2. You are responsible for ensuring that the Personal Information you provide to us is accurate, complete and not misleading and that such Personal Information is kept up to date. If you have reasons to believe that your records with us are inaccurate, incomplete or not updated, please write in to us at [email protected] or call us at 603-4051 2041. We will promptly rectify your Personal Information accordingly.

  1. We may use the Personal Information in one or more of the following circumstances or for one or more of the following purposes (collectively referred to as “Purposes”) and you hereby consent to the processing by FINTANI of your Personal Information in accordance with the Purposes as set forth below:
    1. To provide you with products and/or services that you have registered/applied with us;
    2. To facilitate your registration and/or application for FINTANI’s products and services;
    3. To perform credit check, credit assessment, credit worthiness, financial standing, eligibility of your Application;
    4. To enable the sharing, transfer, retrieval, updating and processing of your personal information and data as well as creation of member profile and user accounts to enable you to receive the services related to FINTANI and between our related affiliates, subsidiaries, respective group companies, parent company, associates to provide you with the products and services in relation thereto;
    5. To enable the sharing, disclosure, transfer, retrieval, updating and/or processing of Personal Information with FINTANI service providers, licensees, contractors, advisors, consultants, merchants and/or strategic partners in order to provide you the products and/or services in relation thereto;
    6. To enable the processing of your personal information to administer and enable the continuous operation of your account created in FINTANI;
    7. To provide you with information on any transaction you have performed in the App;
    8. To process your payment transactions and for other operational and administrative purposes, including without limitation, sending you notifications, and managing your account;
    9. Communications and ensuring customer satisfaction, which may include conducting surveys to improve the quality of our Services, responding to inquiries and complaints and to generally resolve disputes or to enforce our terms and conditions, including the terms and conditions relating to our Services;
    10. Maintaining your transaction history for present and future reference (as and where required);
    11. For legal documentation consequent to a contract or product and service granted to you;
    12. For such other purposes as set out in any other terms and conditions (if applicable) and campaign terms and conditions (if applicable); and
    13. For any purpose made known to you at the time of collection of your Personal Information.
  2. FINTANI use general, aggregated information to generate statistics and measure site activity to improve the usefulness of customer visits. Such information does not include Personal Information.

  1. We may disclose your Personal Information to:
    1. Our related corporations, affiliates, subsidiaries, associates, service providers, licensees, advisors, merchants, strategic partners, third party contractors, credit reporting agencies, whether located within or outside Malaysia for the Purpose;
    2. Payment network operators, governmental agencies, regulatory authorities (including Bank Negara Malaysia), enforcement agencies, whether located within or outside Malaysia for the Purpose;
    3. Any credit reporting agency, credit bureau, and/or financial institutions;
    4. Any government agencies, statutory authorities, law enforcement agencies under the applicable law.
    Your Personal Information may also be disclosed to other third parties with whom we have commercial relationships, for marketing, advertising and related purposes, unless you have indicated that you do not wish for FINTANI to disclose to such third parties for marketing and advertising purposes, and as required or authorized under law or provided in co-operation with any governmental authority.

  1. We emphasize the importance of security for your Personal Information and we will take reasonable steps (such as regular review and implement security measures based on industry practice standard) to protect any Personal Information from any misuse and loss and from unauthorized access, modification or disclosure of the Personal Information. We may hold your information in either electronic or physical form or engage third parties to hold that information on our behalf whereby we will ensure to procure such third parties to incorporate our security standards as a minimum. Where required by applicable laws or after seven (7) years, Personal Information will be destroyed or de-identified when no longer needed.
  2. You are not to disclose any of your sensitive information including your password in your FINTANI to anyone. Changing your password and mobile number require two-factor authentication (“2FA”) to ensure extra security of your Personal Information.
  3. Whilst we do our best in ensuring your Personal Information is well protected, FINTANI cannot provide any assurance nor guarantee regarding the security to the transmission of information you communicate to us due to the inherent insecurity of the Internet or other issues which we have no control over.

  1. The App may contain links to websites or applications operated by third parties (“Third Party Applicationsor Websites”). Whenever you click on a link or do such other actions as requested to connect to any other Third Party Applications or Websites, you will leave our App and be redirected to other Third Party Applications or Websites that may require to collect Personal Information from you. We have no control and are not responsible for the privacy practices or the content of those Third Party Applications or Websites. Third Party Applications and Websites are responsible for informing you about their own privacy practices. This Policy does not apply nor extent to those Third Party Applications or Websites in regard to their content or to any collection of data after your action in connecting to them. We are not responsible for any risks or loss or damages from the Third Party Applications or Websites.

  1. You have the right to access to your Personal Information in the FINTANI’s profile setting. You can make the appropriate changes to your Personal Information to reflect the latest information.

    Certain Personal Information may require you to contact FINTANI’s customer service to make the changes. If you believe that said Personal Information that FINTANI has about you is incorrect, incomplete or inaccurate, then you may request to amend it with evidence. We will consider if the information requires amendment.

  2. You may at any time make written inquiries and, upon payment of a prescribed fee, request, in writing, for access to, or correction of, your Personal Information (including personal data of others provided by you). In accordance with PDPA 2010, and to the extent not limited by any other applicable law (if applicable), FINTANI may refuse to comply with your request for correction to the Personal Information and give you a reason for our refusal.
  3. Wherever arise situation that made it mandatory or obligated for you to provide your Personal Information for us to process, or for us to provide the services necessarily to you in your application to FINTANI. Should you decline, reject, reluctant or refuse to provide us with such Personal Information which we deemed mandatory or obligatory, we may not being able to process your application and/or provide you with our Products and Services and we reserve our rights to reject your application on any reasonable grounds.

We may review, revise and update this Privacy Policy from time to time to reflect changes to the latest development of the laws, business or industry practices, procedures, business process and/or structure etc. The latest version of our Privacy Policy will be made available in the App.

In the event that you do not agree with the changes made by us on the use of your Personal Information, you must notify us immediately and/ or cease the use of our Products and Services. If you choose to continue in using our Products and Services, it shall deemed to us that you have indicate your acknowledgement on the changes and to have bound by the changes made to the Privacy Policy.
